Hearing representation tips
June 2005TALX UC eXpress, your claims manager, is the only claims manager to have a network of local service offices and nearly 300 third party hearing consultants across the country, which allows them to provide trained and experienced hearing representatives throughout the country. To benefit fully from their capabilities, we go beyond helping members prepare for hearings, by actually providing an experienced hearing representative for every claim a member chooses to protest. The result is effective control of claim costs with a minimum expenditure of your staff time.
Your claims representative will contact you to identify appeal options available if an unfavorable decision is received on a claim. After the claim is appealed, she will contact you when the unemployment hearing is scheduled. A hearing representative will be assigned to your case. This individual will prepare witnesses, discuss strategy, determine documentation to be presented and represent you at the hearing. By having a representative at the hearing, you will be assured that all necessary elements of the case are presented.
As a member, your role in the appeals process is as follows:
- Assist in identifying first-hand witnesses and providing them to your hearing representative.
- Provide a copy of the policies and or procedures relating to the infraction/s.
- Provide additional information your claims representative/hearing representative might need, including but not limited to the following:
- Dates of employment
- Rate of pay
- Job description
- Days/hours worked
- Reason for separation
- Signed resignation (quits)
- Documentation - written warnings (discharges)
- Detailed description of last incident preceding separation (discharge cases)
The more quickly your claims/hearings representative receives the information, the more effectively TALX UC eXpress can represent you at the hearing.
